Should I file now or wait if Bowling Green insurers keep blaming each other?
You may have as little as 1 year before you lose a Kentucky injury claim against a non-driver party, and waiting is the mistake that sends people searching for this in December.
The common bad move is to sit tight while the driver's insurer, the road contractor's insurer, and sometimes a company vehicle carrier all point fingers at each other. That feels safer, especially if you are worried that reporting the crash will expose your immigration status. In reality, delay helps the insurers, not you.
The smarter path is file now, not later.
If your crash involved a Bowling Green pileup on I-65, a work-zone setup, poor lane closures, or a commercial vehicle, there may be claims against more than one person or company at the same time: another driver, an employer, a trucking company, or a road contractor. Kentucky does not require you to wait for those companies to agree on who is at fault before you protect your claim.
Do this right away:
- Report the crash and injury, and get the police report from Bowling Green Police or Kentucky State Police
- Open the insurance claim with every potentially involved carrier
- Keep all treatment records and wage-loss proof
- Do not sign a release from one insurer while others are still disputing fault
In Kentucky, fault can be split among multiple parties. One insurer saying "we're still investigating" does not pause your deadline. And if one company pays bills now, a subrogation or reimbursement claim may show up later from health insurance, Medicaid, workers' comp, or another carrier.
Being undocumented does not erase your right to seek payment for medical care and injuries after a crash. A normal injury claim in Kentucky is not the same thing as asking immigration authorities for anything. The urgent issue is preserving the claim before the clock runs out.
The information above is educational and does not create an attorney-client relationship. Every injury case turns on its own facts. If you're dealing with this right now, get a professional opinion.
